Perplex Terms of Use

Introduction

Please read these Terms of Use (hereafter "Terms") carefully as they govern your use of services provided by Perplex Learning Incorporated (hereafter "Perplex"), including the website perplex.org (hereafter "Service"). These Terms also govern all materials created or made available through Perplex, including problems, notes, images, videos, and any other instructional materials (hereafter "Content").

By using Perplex, you agree to these Terms. If you do not agree to these Terms, you must not use Perplex.

Changes to Terms

We may make changes to these Terms at any time, and notify you of such changes by any reasonable means, including by posting the revised Terms on the applicable Perplex Service. For any material changes, we will endeavor to notify you by email, in-service popup message, or any other means. Your use of Perplex following any changes to these Terms will constitute your acceptance of all changes.

We reserve the right to modify or discontinue any subscription plans, pricing, or features of the Service at any time. For any material changes to your subscription, we will notify you at least 30 days in advance. Your continued use of the Service after such changes take effect constitutes your acceptance of the new terms.

Service Provider

These Terms are between you and Perplex Learning Incorporated, 225 Dyer Street, Providence RI 02906, USA.

Intellectual Property Rights

All content on the Perplex website is protected by copyright. The website may only be used for personal, non-commercial purposes. This includes all website content, technology, services, software, materials, communications, text, graphics, links, art, animations, audio, video, photos and other data (collectively "Perplex Content"), which are provided by Perplex or authorized third parties and are their copyrighted works.

Unless explicitly authorized by Perplex or the relevant rights holder, you may not:

• Copy, reproduce, publish or distribute any Perplex Content
• Modify or create derivative works
• Rent, lease, sell or transfer any content
• Display, transmit, compile or collect content in a database
• Commercially exploit any part of the content or services

All website materials are for individual use only. Account sharing or transfers are not permitted. You may not store any significant portion of Perplex content or materials. Perplex and its third-party providers retain full ownership of all content - you do not acquire any intellectual property rights.

All website content has been independently developed by Perplex. The International Baccalaureate Organisation has not endorsed this website.

Using Perplex

Your rights of use

Subject to your compliance with these and any other applicable Terms, we grant to you a limited, non-exclusive, revocable license to make personal and/or instructional use of Perplex (hereafter "Access"). You may not redistribute or transfer any Content accessed through Perplex. The Perplex software applications - as well as any content you access through them - are not sold or transferred to you, but licensed according to the aforementioned permission. You do not own any content accessed on Perplex, and your rights include only those explicitly laid out in these Terms.

Service limitations

This Access will remain in effect unless and until it is terminated, either by you or by Perplex. Access can be amended at any time, including but not limited to new or changed payment requirements for all or parts of the Access.

Perplex has no obligation to provide any Content. All content can be altered, restricted, or deleted at any time.

Your account

You may be required to create an account to use some features on Perplex. You are responsible for keeping your login credentials confidential, and are responsible for all use (including unauthorized use) of your credentials. Perplex may require you to change, or reclaim, your username for any reason.

You may establish an account only on your own behalf or on the behalf of some Organization which has given you express permission to do so. In the latter case, the terms "you" and "your", as used in these Terms, apply to both you and the Organization.

Content accuracy and AI-generated content

While we strive to provide accurate and helpful content, Perplex makes no warranties about the accuracy, reliability, or completeness of any content on our Service. This includes both human-created content and content generated by our artificial intelligence features.

Our AI products generate content using complex algorithms and models. While we work to ensure high quality output, AI-generated content may contain errors, inconsistencies, or inappropriate responses. You acknowledge and agree that Perplex is not liable for any damages or losses resulting from your use of or reliance on any content accessed through our Service, including AI-generated content.

You should always verify important information from authoritative sources and use your own judgment when applying content from our Service to your studies or other activities.

Exam Results

While Perplex aims to help students prepare for IB Mathematics examinations, we make no guarantees about exam results or scores. Your performance on actual IB examinations depends on many factors beyond our Service. You acknowledge and agree that Perplex is not liable for any exam results, scores, or academic outcomes that may occur during or after using our Service.

Privacy and Data Collection

Your use of Perplex is also governed by our Privacy Policy, which can be found at perplex.org/privacy. The Privacy Policy describes how we collect, use, and share your personal information when you use our Service. By using Perplex, you also agree to our Privacy Policy.

User Conduct

You agree not to engage in any of the following prohibited activities:

• Using the Service for any illegal purpose
• Attempting to gain unauthorized access to the Service
• Interfering with or disrupting the Service
• Sharing accounts or access credentials
• Uploading malicious code or content

Payment Terms

Subscription fees are billed in advance on a monthly or annual basis. All payments are non-refundable except where required by law. You may cancel your subscription at any time, but no refunds will be issued for partial subscription periods.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. PERPLEX DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

Dispute Resolution

Any dispute arising from these Terms will be governed by the laws of Rhode Island, USA. You agree to first attempt to resolve any disputes informally. If informal resolution is not possible, any disputes shall be resolved through binding arbitration in Providence, Rhode Island.

Termination

We may terminate or suspend your access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease.

Copyright Complaints

If you believe your copyrighted work has been infringed on our platform, please submit a notice to us containing:

• Your physical or electronic signature as the copyright owner or authorized agent
• A description of the copyrighted work and where the allegedly infringing material is located
• Your contact details including address, phone number, and email
• A statement that you have a good faith belief the use is not authorized by the copyright owner
• A statement, made under penalty of perjury, that the information provided is accurate and you are authorized to act on the copyright owner's behalf
